1. Agreement
By using PostBear ("the Service"), you agree to these Terms of Service. The Service is provided by 33coders Damian Krawcewicz, Zaruskiego 12B/12, 81-577 Gdynia, Poland (VAT: PL5862031923).
2. Description of Service
PostBear is a social media scheduling tool that enables users to schedule and publish content to Facebook Pages and Instagram Business accounts via the Meta Graph API.
3. User Responsibilities
- You are responsible for maintaining the security of your Meta API access tokens and Cloudflare credentials.
- You must comply with Meta's Platform Terms and Community Standards when publishing content.
- You must not use the Service to publish spam, misleading content, or content that violates applicable laws.
- You are solely responsible for the content you schedule and publish through the Service.
4. Meta Platform Compliance
PostBear operates within the Meta Platform Terms of Service. Your use of the Service is also governed by Meta's policies, including but not limited to their Developer Policies, Platform Terms, and Community Standards. You acknowledge that Meta may revoke API access at any time.
5. Intellectual Property
You retain all rights to the content you create and schedule through PostBear. We claim no ownership over your posts, images, captions, or other creative work.
6. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law:
- We are not liable for failed or delayed post scheduling due to Meta API errors, rate limits, or platform changes.
- We are not liable for content moderation actions taken by Meta against your accounts.
- Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
7. Data Processing
Data processing is governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.
8. Termination
You may stop using the Service at any time. We reserve the right to suspend or terminate access if you violate these Terms or Meta's platform policies.
9. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Poland and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gdynia, Poland.
